Employment mediation
Employment mediation generally takes place when the employment relationship has ended and a dispute exists between the employee and the employer. This will often be in the form of a claim or potential claim in the employment tribunal or, in some cases, in court. Employment mediations usually take place over the course of one day.

Workplace mediation
Workplace mediation takes place when there is a conflict between two or more employees in the workplace and the employment relationship is continuing. Hilary is trained in a number of techniques which help the participants to change the way in which they interact so that they can find a way of moving forward from their dispute and working together in a less challenging environment.
Although some larger employers offer internal mediation as an means of resolving conflict in the workplace, the perception that the internal mediator is not genuinely ‘independent’ (often being a member of the HR department) can undermine trust in the mediation process. Hilary offers genuine neutrality to enable employees to trust in the process and to increase the chances of an enduring solution to the dispute.

Workplace mediation is a staged process requiring careful planning. The process is usually initiated by the employer (with the agreement of the employee/s) and the employer will usually pay for the mediation service and is therefore the 'client'.
The workplace mediation process will usually start with a background briefing to the mediator by the client and is typically followed by a series of individual meetings between the mediator and the parties. These individual meetings are then usually followed by a joint meeting of all parties. Sometimes further individual meetings take place after the joint meeting.

At HG Mediate we have the facilities to offer mediations online.
Although the concept of online mediation may be unfamiliar to some, we have found that they work well and the systems we use are easy to use and access.
We use Zoom as our preferred platform because it enables the mediator to set up the online meeting and include private 'breakout' rooms for the parties. These 'breakout' rooms closely simulate the private meeting room arrangements of a face-to-face mediation as different parties and their representatives can be brought together and can ‘meet’ privately with the mediator in their private 'breakout' rooms.
We are confident in recommending online mediation for a wide range of cases and we are happy to set up a practice session with anyone who is unsure about how it might work for them.
